1. Acceptance of Terms

By making a booking, completing a payment, or using any service offered by ROA LIVE through roatanlive.com or any official channel, the client declares to have read, understood, and fully accepted these Terms of Service ("the Terms"), as well as the current Refund & Cancellation Policy.

If the client acts on behalf of a group or third parties, they declare to have express authorization from each participant to accept these Terms on their behalf, and assume joint liability for compliance.

Acceptance of these Terms is a mandatory requirement to complete any booking. If the client disagrees with any condition, they must refrain from using ROA LIVE's services.

2. Service Description

ROA LIVE is a tourism services company based in Roatán, Bay Islands, Honduras. Available services include, but are not limited to:

  • Guided tours — snorkeling, scuba diving, land excursions, marine wildlife observation, and similar activities.
  • Transfers — ground passenger transportation to/from Coxen Hole pier, Juan Manuel Gálvez Airport, and hotels on the island.
  • Day passes — access to beach properties, pools, and amenities in Roatán.
  • Premium experiences and special packages — VIP packages, customized experiences, night diving, and exclusive activities.

Availability, descriptions, prices, and specific conditions for each service are listed on the corresponding product page on roatanlive.com and may be subject to change without prior notice, except for already confirmed and paid bookings.

3. Third-Party Operators

Important notice regarding service providers: Some services offered by ROA LIVE may be executed, in whole or in part, by duly authorized independent tourism operators ("Third-Party Providers"). ROA LIVE acts as an intermediary agent between the client and the Third-Party Provider.

When a service is operated by a Third-Party Provider:

  • ROA LIVE selects its providers based on quality, experience, and compliance with applicable safety regulations in Honduras.
  • The Third-Party Provider bears direct responsibility for the execution of the service and safety conditions during its delivery.
  • ROA LIVE shall not be liable for acts, omissions, negligence, or failures exclusively attributable to the Third-Party Provider, beyond its obligation to facilitate the management of complaints.
  • ROA LIVE commits to acting in good faith to manage any client complaint with the corresponding Third-Party Provider.

4. Bookings and Confirmation

A booking is considered confirmed only when the client receives a written confirmation from ROA LIVE (via email or official message), along with the corresponding payment receipt.

  • ROA LIVE reserves the right to decline or cancel a booking for operational, safety, or capacity reasons, in which case a full refund will be issued.
  • Information provided by the client at booking must be truthful and complete. ROA LIVE assumes no liability for inconveniences arising from incorrect information submitted by the client.
  • It is the client's responsibility to verify booking details (date, time, meeting point, number of participants) before the service date.

5. Prices, Payments, and Taxes

All prices on roatanlive.com are expressed in US dollars (USD) and include applicable taxes under current Honduran law, unless expressly stated otherwise.

  • ROA LIVE accepts payments through the payment gateways enabled on roatanlive.com. Third-party processing fees are the client's responsibility where applicable.
  • Prices may change without prior notice. The applicable price is the one in force at the time of booking confirmation and payment.
  • ROA LIVE is not responsible for additional charges applied by the client's bank (international transaction fees, exchange rate differences, etc.).

6. Client Obligations and Responsibilities

By booking ROA LIVE's services, the client agrees to:

  • Arrive at the agreed meeting point at least 15 minutes before the scheduled service start time.
  • Follow all safety instructions provided by guides, captains, and staff of ROA LIVE or the Third-Party Provider at all times.
  • Truthfully disclose any medical, physical, or health condition that may affect safe participation (allergies, heart conditions, pregnancy, injuries, phobias, etc.).
  • Not participate in activities under the influence of alcohol, drugs, or any other substance that impairs physical or mental capacity.
  • Treat ROA LIVE staff, fellow participants, and the natural and cultural resources of the destination with respect.
  • Comply with environmental regulations applicable in Roatán, including coral reef protection rules under the Mesoamerican Reef System framework.
  • Supervise any minors in their care throughout the duration of the service.
Right of admission: ROA LIVE reserves the right to refuse or suspend service to any client who fails to follow safety instructions, displays disrespectful or aggressive behavior, or is deemed a risk to themselves, other participants, or the environment. No refund will be issued in these cases.

7. Minors

Persons under 18 years of age may participate only under the direct supervision and responsibility of an adult (parent or legal guardian) who has accepted these Terms on their behalf.

  • Some activities have a minimum age requirement stated in the product description. ROA LIVE may request a valid ID to verify age.
  • The responsible adult assumes joint liability for all client obligations on behalf of the minor in their care.

8. Inherent Risks and Limitation of Liability

The client expressly acknowledges and accepts that ROA LIVE's activities involve inherent risks that cannot be fully eliminated, even when all reasonable safety measures are in place. These risks include:

  • Variable and unpredictable sea conditions, currents, wind, and underwater visibility.
  • Encounters with wild marine life (stingrays, barracudas, jellyfish, fire coral, reef sharks, etc.).
  • Individual physical reactions to exertion, heat, diving or snorkeling equipment, or undisclosed pre-existing medical conditions.
  • Accidents during outdoor activities resulting from the natural environment (uneven terrain, wet surfaces, moving vessels).

ROA LIVE limits its liability to damages directly caused by proven negligence of its staff. ROA LIVE assumes no liability for injuries, material losses, or damages arising from: failure to follow safety instructions, undisclosed pre-existing health conditions, improper use of equipment, acts of third parties, loss of personal belongings, or inherent risks of the activity.

In no event shall ROA LIVE's total liability to a client exceed the amount actually paid for the contracted service.

Recommendation: ROA LIVE strongly encourages all clients to purchase travel insurance covering water sports and adventure activities before visiting Roatán.

9. Marine Wildlife — No Sighting Guarantee

ROA LIVE operates within the natural environment of the Mesoamerican Reef System. Accordingly, ROA LIVE does not guarantee sightings of specific marine species during tours, as this depends on natural factors beyond ROA LIVE's control. The absence of wildlife sightings does not constitute a breach of service and does not entitle the client to a refund.

The client agrees to respect reef conservation rules: no touching, stepping on, or collecting coral, organisms, or sediments from the sea floor.

10. Photography, Video, and Image Rights

By booking, the client grants ROA LIVE a non-exclusive, royalty-free, worldwide license to use their likeness in marketing materials and social media, unless the client expressly objects in writing before the start of the service.

  • ROA LIVE will not commercialize the client's image individually or share it with third parties for other purposes.
  • For minors, express written consent from a parent or legal guardian is required.
  • The client may request removal of their image by emailing info@roatanlive.com.

11. Intellectual Property

All content published on roatanlive.com — including texts, photographs, logos, videos, designs, and trademarks — is the property of ROA LIVE or its licensors and is protected by Honduran intellectual property laws. Reproduction, distribution, or commercial use without prior written authorization is strictly prohibited.

12. Personal Data Protection

ROA LIVE collects and processes client personal data solely for booking management, service-related communications, and, with the client's consent, for commercial communications.

  • Data will not be sold or shared with third parties, except with Third-Party Providers operating the booked service, to the extent strictly necessary.
  • The client has the right to request access, rectification, or deletion of their data by emailing info@roatanlive.com.

13. Force Majeure and Acts of God

ROA LIVE shall not be liable for failure to fulfill its obligations when such failure is a direct consequence of force majeure or acts of God, including natural phenomena, pandemics declared by a competent authority, government actions, civil unrest, or any event beyond ROA LIVE's reasonable control. The current Refund & Cancellation Policy will apply in such cases.

14. Client Indemnification

The client agrees to indemnify and hold harmless ROA LIVE, its directors, employees, guides, captains, and Third-Party Providers against any claim, damage, loss, cost, or expense arising from: breach of these Terms, false information provided at booking, damage caused to facilities or the natural environment, or third-party claims arising from the client's acts during the service.

15. Updates to These Terms

ROA LIVE reserves the right to update these Terms at any time. Changes will be published on roatanlive.com with at least 15 days' notice before taking effect.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Honduras. For disputes that cannot be resolved amicably, the parties agree to submit to the jurisdiction of the competent courts of the Bay Islands department, Honduras, without prejudice to the consumer's right to contact the DGPC.
